Terms and Conditions

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  1. Cooling-off Period: The period within which the consumer can exercise their right of withdrawal.
  2. Consumer: The natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
  3. Day: A calendar day.
  4. Continuous Transaction: A distance contract concerning a series of products and/or services, where the delivery and/or purchase obligation is spread over time.
  5. Durable Data Carrier: Any tool that allows the consumer or entrepreneur to store information addressed to them personally in a way that allows future access and unchanged reproduction of the stored information.
  6. Right of Withdrawal: The option for the consumer to withdraw from the distance contract within the cooling-off period.
  7. Entrepreneur: The natural or legal person who offers products and/or services remotely to consumers.
  8. Distance Contract: A contract concluded within the framework of an organized system by the entrepreneur for selling products and/or services remotely, up to and including the conclusion of the contract using only one or more means of distance communication.
  9. Means of Distance Communication: A tool that can be used to conclude a contract without the consumer and entrepreneur being simultaneously present in the same room.
  10. General Terms and Conditions: The present document containing the General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

  1. These General Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
  2. Before the distance contract is concluded, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate how the terms can be inspected and will send them free of charge upon request.
  3. If the distance contract is concluded electronically, the text of these General Terms and Conditions may also be provided electronically in such a way that the consumer can easily store them on a durable medium. If this is not possible, the entrepreneur will indicate where the terms can be accessed electronically and will send them upon request, free of charge.

Article 4 – The Offer

  1. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.
  2. The offer is non-binding. The entrepreneur is entitled to modify and adapt the offer.
  3. The offer contains a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer. Images used by the entrepreneur are truthful representations of the products and/or services. Obvious mistakes or errors in the offer do not bind the entrepreneur.
  4. The price is stated clearly, excluding customs duties and import VAT.
  5. Shipping costs and other obligations are clearly detailed in the offer.

Article 5 – The Contract

  1. The contract is concluded, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and meets the corresponding conditions.
  2. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance electronically.
  3. The entrepreneur may conduct a background check to assess the consumer’s ability to fulfill their payment obligations and other criteria before accepting the contract.

Article 6 – Right of Withdrawal

  1. The consumer may withdraw from the contract without giving reasons within 14 days.
  2. The cooling-off period starts the day after the consumer or a designated third party receives the product.

Article 7 – Costs in Case of Withdrawal

  1. If the consumer exercises their right of withdrawal, they will bear the costs of returning the products.
  2. The entrepreneur will reimburse any payments made by the consumer, including standard shipping costs, within 14 days after receiving the returned product or proof of return.

Article 8 – Exclusion of Right of Withdrawal

The entrepreneur may exclude the right of withdrawal for specific products or services, such as:

  1. Products made to the consumer's specifications.
  2. Perishable goods.
  3. Sealed products not suitable for return for health or hygiene reasons once unsealed.

Article 9 – Price

  1. Prices for the offered products and/or services will not increase during the validity period of the offer, except for price changes due to VAT regulations.
  2. Any errors in pricing or descriptions are non-binding and do not obligate the entrepreneur to honor incorrect prices.

Article 10 – Conformity and Warranty

  1. The entrepreneur guarantees that the products and/or services comply with the contract, the specifications in the offer, reasonable requirements of reliability, and legal provisions.
  2. Defects must be reported within 14 days of delivery.

Article 11 – Delivery and Execution

  1. The entrepreneur will handle the delivery of products with the utmost care.
  2. If a product is unavailable, the entrepreneur will notify the consumer and may offer a substitute.

Article 12 – Continuous Transactions

  1. Continuous transactions may be canceled by the consumer with a maximum notice period of one month.
  2. Renewals or extensions of contracts are only permitted under specific conditions detailed in the agreement.

Article 13 – Payment

  1. Payments must be made within seven business days unless otherwise agreed upon.
  2. In case of late payment, the entrepreneur reserves the right to charge reasonable costs after notifying the consumer.

Article 14 – Complaints

  1. Complaints must be reported within seven days after the defect is identified.
  2. The entrepreneur will respond to complaints within 14 days.

Article 15 – Disputes

  1. These Terms and Conditions and any contracts are governed by Dutch law, even if the consumer resides abroad
